In the case of Summa Health System vs. Western Reserve Hospital Partners and Western Reserve Hospital, a Summit County Common Pleas Court Jury returned verdicts on the claims on July 1, 2016. The court discharged the jury on July 5. Both sides then filed post-trial motions. Judge Lynne Callahan then submitted the judgment entry in the case on Aug. 15. Here are the specifics of that judgment:
Summa has the right under the operating agreement to approve the terms of any transaction between the Hospital and the Partners, its affiliates or affiliated physicians;
Summa has the right to access Western Reserve Hospital's books and records under both the operating agreement and state law;
Summa is awarded $10 in compensatory damages on Summa's claim for breach of the operating agreement;
Summa is awarded $906,464 in compensatory damages on Summa's claim for breach of the management services agreement;
Western Reserve Hospital Partners is awarded $10 in compensatory damages on the hospital partners' claim of breach of a May 27, 2015 agreement; and
Summa must comply with a section of the lease by allowing a third appraiser to assist the appraisers in determining the fair market value of the hospital building as described in the lease agreement, but the hospital was not awarded any compensatory damages.
